Welcome to Capone’s Prohibition Pizza & Bootleg Fries (“we”, “us”, “our”). By accessing our website or placing an order with us, you agree to these Terms & Conditions. Please read them carefully before ordering.

  1. About Us
    Capone’s Prohibition Pizza & Bootleg Fries operates as a delivery-only dark kitchen offering pizzas, fries, burgers and related food products.

    We prepare all food on-site and deliver using our own trained drivers. Just Eat and other platforms may be used for marketing or visibility only; all orders are processed directly through our own systems.
     
  2. Placing an Order
    Orders may be placed through our website, by telephone, or by collection if offered. You are responsible for providing accurate delivery details and ensuring you are available to receive your order. We may refuse or cancel orders where fraud, abuse, or error is suspected, or where we cannot fulfil delivery.
     
  3. Prices and Payment
    All prices are shown in GBP and may change at any time. Payment must be completed before food preparation begins. We accept card payments and approved digital payment methods. If an item is unavailable, we may offer an alternative or refund the affected item.
     
  4. Delivery
    Delivery times are estimates and may vary due to traffic, weather, demand, or safety considerations. Drivers will attempt to contact you if needed. If you do not answer and the driver is unable to deliver, no refund will be provided. Food will not be left unattended unless you explicitly request it and accept responsibility for safety and temperature.
     
  5. Allergies and Dietary Information
    All food is prepared in a kitchen that handles all 14 major allergens. Cross-contamination is possible, even with best practices in place. Customers with allergies must contact us before ordering. We do not accept liability for reactions where allergen risks were communicated.
     
  6. Alcohol Sales and Challenge 25
    By ordering alcohol, you confirm you are at least 18 years old. Drivers must request ID if you appear under 25. Acceptable ID includes a passport, driving licence, PASS card, or Armed Forces ID. If valid ID cannot be provided, alcohol will not be delivered. The food portion of the order may still be delivered, but alcohol will be refunded or withheld according to our policies and licensing conditions. Alcohol cannot be left unattended, given to neighbours, or delivered to minors or intoxicated individuals.
     
  7. Refunds and Order Issues
    We do not provide refunds for subjective quality concerns such as spice level, sauce thickness, taste preferences, or items not eaten.
    Refunds or redeliveries may be considered for:
     

  • Missing items
  • Incorrect items
  • Food delivered in unsatisfactory condition due to an error on our part
    Customers must report issues within 15 minutes of delivery or collection and provide photographs if requested. Decisions are made at management discretion.
     

  1. Food Temperature Responsibility
    Once delivered or collected, you are responsible for the safe handling, consumption, storage, and reheating of food. We do not accept liability for food safety where items were not consumed immediately or were improperly stored after delivery.
     
  2. Cancellations
    Orders cannot be cancelled once preparation has begun. Alcohol orders cannot be cancelled after dispatch. If you need to amend or cancel an order, you must contact us immediately; we may not always be able to accommodate changes.
     
  3. Customer Conduct
    We reserve the right to refuse service to anyone who behaves abusively, attempts to circumvent age verification, provides false information, or misuses our services. Fraudulent chargebacks or dishonest refund claims may result in refusal of future service.
     
  4. Website Use
    You must not misuse our website, copy our content, attempt unauthorised access, or engage in activity that disrupts our service. All branding, menu text, images, item names, and website content remain the property of Capone’s Prohibition Pizza & Bootleg Fries.
     
  5. Limitation of Liability
    We are not liable for losses arising from delays, missed deliveries caused by incorrect customer information, allergic reactions where allergen information was provided, or food safety issues occurring after delivery.
    Our maximum liability is limited to the value of the order placed.
     
  6. Data Protection
    We comply with the Data Protection Act 2018 and UK GDPR. For details on how we handle your data, please refer to our Privacy Policy.
     
  7. Changes to These Terms
    We may update these Terms & Conditions at any time. Updates take effect as soon as they are published on this page.
